Drug Trafficking Laws & Penalties in Texas

In Texas, drug trafficking refers to the illegal sale, transportation, import, or distribution of controlled substances, including but not limited to drugs like cocaine, heroin, methamphetamine, MDMA (ecstasy), LSD, and marijuana. Texas law categorizes controlled substances into different penalty groups, ranging from Penalty Group 1 (most serious) to Penalty Group 4 (least serious).

Penalties for drug trafficking offenses are typically based on the penalty group, the amount of the drug involved, and any previous criminal history.

The following are the penalties for drug trafficking offenses in Texas, based on the penalty groups:

  • Penalty Group 1 (Cocaine, heroin, meth, oxycodone, etc.):

    • Less than 1 gram: State jail felony punishable by 180 days to 2 years in a state jail facility and a fine of up to $10,000.
    • 1 gram to less than 4 grams: Third-degree felony punishable by 2 to 10 years in prison and a fine of up to $10,000.
    • 4 grams to less than 200 grams: Second-degree felony punishable by 2 to 20 years in prison and a fine of up to $10,000.

    • 28 grams to less than 200 grams: Third-degree felony.
    • 200 grams to less than 400 grams: Second-degree felony.
    • 400 grams or more: Enhanced first-degree felony.
  • Penalty Group 4 (Compounds with small doses of codeine or opium):

    • Less than 28 grams: Class B misdemeanor punishable by up to 180 days in county jail and a fine of up to $2,000.
    • 28 grams to less than 200 grams: Third-degree felony.
    • 200 grams to less than 400 grams: Second-degree felony.
    • 400 grams or more: Enhanced first-degree felony.

These penalties can be enhanced if aggravating factors are present, such as selling drugs to minors, involvement in a criminal organization, or proximity to schools or other designated areas.
